1. competition and organiser
The organiser of the competition is SKYLOTEC GmbH, Im Mühlengrund 6-8, 56566 Neuwied, Germany (hereinafter "the organiser").
(hereinafter referred to as the "Organizer").
Participation is governed exclusively by the following conditions of participation.
2 Participation
a) Any natural person over the age of 18 from EU is eligible to participate. However, employees of the Promoter are excluded from participation.
b) Participation in the competition is only possible while the survey is being conducted.
c) Participation is free of charge and does not require the purchase of any goods or services.
d) Participation in the competition is dependent on the complete completion of all questions in the survey. Only such entries can be considered within the competition. Incorrect or incomplete entries will not be considered. The organiser cannot be held responsible for late or incomplete entries.
e) By entering the competition, the entrant agrees to be bound by these terms and conditions.

b) The promotion is from 01.-24.12.21.
c) The winners will be drawn on the working day following the end of the competition and notified by email; they must confirm receipt of the prize notification and claim the prize within two weeks of the prize notification by the contact method specified within this notification. If this confirmation is not received, the prize will be awarded to another participant.
d) The claim to the prize shall also lapse if the prize cannot be transmitted within four weeks of the first notification of the prize for reasons for which the winner is responsible. The transmission will only take place within Germany. If, after the winner has been drawn, it transpires that the winner does not have the necessary postal address within Germany as stated in the conditions of participation, the prize will be awarded to another participant in the prize draw.
e) The claim to the prize cannot be assigned and is not transferable; furthermore, the prize cannot be paid out, amended or changed. If the prize cannot be made available for any reason whatsoever, the Promoter reserves the right to award a substitute prize of equal value.

4. exclusion from participation

a) In the event of a breach of these terms and conditions, the Promoter reserves the right to exclude participants from the competition.
b) Furthermore, the organiser reserves the right to exclude participants who use unauthorised aids or otherwise obtain advantages through manipulation, for example through collective or multiple entries. This is the case, for example, if automatic scripts, hacking tools, Trojans or viruses are used, or if a participant gains an advantage through other unauthorised means. Furthermore, untrue personal data and the use of "fake profiles" can lead to exclusion. In such cases, winnings may also be subsequently withdrawn and/or reclaimed.

5 Premature termination or cancellation of the competition

The organiser is entitled to prematurely terminate, suspend or modify the competition if unforeseen circumstances beyond the organiser's control occur which make the original implementation more difficult or unreasonable for the organiser. This includes in particular, but is not limited to, the unauthorised intervention of third parties, technical problems with hardware and software that are beyond the control of the organiser, as well as legal violations that are directly related to the implementation of the competition, in particular manipulative intervention in the course of the competition.

6. data protection

The organiser collects and uses the personal data of participants exclusively within the legally permissible framework. For details on the type and scope of data processing, please refer to our detailed data protection declaration.

When you enter one of the Promoter's competitions, the following personal data will be collected by the Promoter:

Your e-mail address

This data is used by the organiser exclusively to determine the winner, to check compliance with the conditions of participation, and to send the prize. The data processing is accordingly based on Art. 6 para. 1 lit. b) DSGVO.

The organiser will delete the winner's data when it is no longer necessary for the implementation of these purposes. This is usually the case when the prize has been sent and the organiser has ensured that it has reached the winner undamaged.

Of course, every participant has the right at any time to request information about the personal data stored by the organiser in accordance with Art. 15 DSGVO. The same applies to the deletion of the corresponding data by the organiser pursuant to Art. 17 DSGVO, as well as the correction pursuant to Art. 16 DSGVO and blocking of the data pursuant to § 18 DSGVO.

In addition, you may object to data processing by the organiser based on Art. 6 Para. 1 lit. e or f DSGVO under the conditions of Art. 21 DSGVO. Of course, you also have the right to complain about the processing of your data to the competent supervisory authority.

7 Liability of the organiser

The following exclusions and limitations of liability apply to the organiser's liability for damages, irrespective of the other legal requirements for claims:

a) The organiser shall be liable without limitation insofar as the cause of the damage is based on intent or gross negligence.
b) Furthermore, the organiser shall be liable for breaches of essential obligations caused by slight negligence, the breach of which jeopardises the achievement of the purpose of the contract, or for breaches of obligations, the fulfilment of which is essential for the proper implementation of the competition and the observance of which the contractual partners regularly rely on. In such a case, however, the scope of liability for the organiser shall be limited to the foreseeable damage typical for the contract.
c) The organiser is not liable for the slightly negligent breach of obligations other than those mentioned above.
d) The aforementioned limitations of liability do not apply in the case of injury to life, limb and health, for a defect after the acceptance of quality guarantees for the quality of a product and in the case of fraudulently concealed defects. Liability under the Product Liability Act remains unaffected.
e) The exclusion or limitation of liability of the organiser shall also apply to the personal liability of representatives and vicarious agents of the organiser or its employees.
8. final provisions
a) Legal recourse is excluded.
b) The law of the Federal Republic of Germany shall apply to the exclusion of international private law and the UN Convention on Contracts for the International Sale of Goods (CISG) incorporated into German law.
c) Should any of these provisions be or become invalid, this shall not affect the validity of the remaining provisions.
